  • Respect candidate rights regarding their personal data

Violation Consequences

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, removal of content, and potential legal action.

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by shAIrlock and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

10.2 Termination by Us

  • Immediate termination may occur for serious violations or illegal activity
  • We may suspend service pending investigation of suspected violations
  • 30 days notice will be provided for termination without cause (where legally required)

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We will retain your data for a reasonable period to allow for account reactivation, after which it will be deleted in accordance with our data retention policies.

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

AI Technology Disclaimer

Our AI-powered features are tools to assist in the interview process. Final hiring decisions should always involve human judgment and comply with applicable employment laws and regulations. We do not guarantee the accuracy of AI-generated assessments or recommendations.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall shAIrlock be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to or use of our servers
  • Damages resulting from any bugs, viruses, or other harmful code
  • Damages resulting from the conduct of any third party on the Service

Our total liability to you for all damages, losses, and causes of action shall not exceed the amount paid by you to shAIrlock in the twelve (12) months preceding the claim.

Jurisdictional Variations

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless shAIrlock and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

  • Your violation of these Terms or any applicable law or regulation
  • Your violation of any third-party rights, including privacy, publicity, or intellectual property rights

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which shAIrlock operates, without regard to its conflict of law provisions.

  • We will work in good faith to resolve disputes through direct negotiation
  • If informal resolution fails, disputes may be subject to binding arbitration

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
